North Dakota Overtime Lawyer

If you work in North Dakota and your employer hasn't paid you overtime, the federal Fair Labor Standards Act protects you. North Dakota's economy is driven by oil and gas in the Bakken formation, and the most common overtime violations I see there follow the oilfield industry. I represent North Dakota workers in the U.S. District Court for the District of North Dakota, where I'm admitted to practice.

Day rate workers, 1099 contractors, and workers classified as independent operators are among the most commonly misclassified workers in the Bakken. The label on your pay stub or tax form doesn't determine your legal status. The economic reality of your working relationship does.

Which Industries Do I See Most Often Here?

Oilfield and energy.

Bakken formation workers paid day rates, per-well rates, or as 1099 contractors while working 12-hour shifts, 7 on / 7 off rotations, or longer hitches without overtime. After the Supreme Court's 2023 decision in Helix Energy Solutions Group v. Hewitt, the legal framework for most oilfield day rate structures is clear: if you're paid by the day and not guaranteed a minimum weekly salary regardless of hours, no overtime exemption applies.

Pipeline and facilities construction.

Pipeline welders, operators, construction crews, and facilities technicians paid flat project rates or day rates with no overtime. Many are labeled as independent contractors while working exclusively for one operating company or service firm.

Agriculture.

North Dakota is one of the largest agricultural states. Agricultural workers are covered by the FLSA's minimum wage provisions, and certain seasonal and farm labor exemptions have narrow limits that employers frequently push past.

Trucking and water hauling.

Water haulers, crude oil tankers, and supply truck drivers serving oilfield locations. Drivers of vehicles under 10,001 pounds GVWR are not covered by the motor carrier exemption regardless of what the employer claims. Intrastate drivers hauling goods with no out-of-state nexus may also fall outside the exemption.

Healthcare.

Hospital and clinic workers, home health aides, and traveling nurses serving the Williston Basin and Bismarck-Mandan corridors facing automatic meal deductions, off-the-clock charting, and unpaid travel time.

Bakken Overtime Claims

The Bakken produced some of the most significant FLSA day rate litigation in the country. After Helix Energy Solutions Group, Inc. v. Hewitt, 598 U.S. 46 (2023), workers paid a day rate who are not guaranteed a fixed weekly salary regardless of hours worked cannot be classified as exempt employees under the FLSA's highly compensated employee or executive exemptions. That ruling wiped out the primary legal defense most oilfield day rate structures relied on.

If you worked in North Dakota's oilfield or energy sector and were paid a day rate without overtime, your claim is strong. The lookback period is two years, extended to three for willful violations. If there is no recovery, you pay nothing, not even the costs.
