Arenal v. Aranco Builders

This is an active federal lawsuit I filed on behalf of a construction superintendent who was misclassified as an independent contractor and denied overtime pay he earned under the Fair Labor Standards Act.

Background

My client worked as a construction superintendent for Aranco Builders, a Texas-based construction company. Despite the "independent contractor" label on paper, Aranco controlled my client's work in the ways that matter under federal law: it directed where he worked, how he performed the job, and when he showed up. That level of control makes someone an employee under federal law, not a contractor, regardless of what the contract says.

My client regularly traveled long distances for the job, including trips to Columbia, Missouri, and worked Monday through Saturday without overtime compensation. There was no timekeeping system, no tracking of hours, and no overtime pay.

Allegations

Aranco Builders, along with its owner Anargyros Antonopoulos, misclassified my client as an independent contractor to avoid paying overtime. Under the federal economic reality test, my client was an employee. He regularly worked more than 40 hours per week, and the defendants failed to pay him the overtime premium the law requires.

I have sued both the company and its owner individually. Under the federal overtime law, individuals who exercise control over a company's pay practices can be held personally liable.
