Davis v. Cypress Place

This is an active federal lawsuit I filed on behalf of an hourly medication technician whose employer automatically deducted 30 minutes per shift for meal breaks she never took and manipulated her time records to avoid paying overtime.

Background

My client Kelli Davis worked as a medication technician at Cypress Place Assisted Living in Jefferson, Texas. Like many workers in direct care, she rarely if ever got an uninterrupted 30-minute break, because the nature of the job does not allow it. Despite that reality, Cypress Place automatically deducted 30 minutes from every shift, reducing her recorded hours and her paycheck.

On top of that, her employer manipulated her time records to avoid triggering overtime pay when she approached 40 hours in a week. Both practices (automatic break deductions for time actually worked, and altering time records) violate federal overtime law.

Allegations

I have sued Capstone Cypress OpCo LLC (doing business as Cypress Place Assisted Living), its management company MME Capital Holdings LLC, and the facility's Director Beje Foster individually. The defendants systematically shorted workers on pay by deducting time that was actually worked and suppressing overtime through time manipulation. I am pursuing this as a collective action on behalf of all hourly employees who were subject to these practices.

Affected Workers

If you worked at Cypress Place Assisted Living in Jefferson, Texas as a medication technician, caregiver, CNA, or in any other hourly role and experienced automatic lunch deductions or had your time adjusted near the 40-hour mark, you may be owed back pay.
