Garcia v. Lacuna Autism
This is an active unpaid overtime case I filed on behalf of my client Julia Garcia against Lacuna Autism, proceeding in arbitration before the American Arbitration Association.
Case No. txwd-5-2024-cv-00141, W.D. Tex.
Background
My client Julia Garcia worked for Lacuna Autism and was denied overtime pay she earned under the Fair Labor Standards Act. After the company compelled arbitration, the case moved to AAA arbitration, where I continue to pursue her overtime claims.
Arbitration does not eliminate an employer's obligation to pay overtime. Federal overtime protections apply regardless of whether a case proceeds in court or before a private arbitrator.
Allegations
Lacuna Autism failed to pay my client overtime compensation for hours worked over 40 in a workweek, as required by federal law. I am pursuing all available remedies on her behalf, including back pay, liquidated damages, and attorneys' fees.
Affected Workers
If you worked for Lacuna Autism and were denied overtime pay, your situation may be similar. Even if your employment agreement contains an arbitration clause, you may still be entitled to recover unpaid wages under federal law.
