Price v. Complete Ventures

This is an active federal lawsuit I filed on behalf of an installation and security camera technician who was misclassified as an independent contractor and paid a flat weekly rate with no overtime.

Background

My client Dakota Price worked for Complete Ventures LLC as an installation and security camera technician. He was treated as an independent contractor and paid $800 per week, a flat rate that did not change regardless of how many hours he worked. He regularly worked 50 to 60 hours per week.

At 50 to 60 hours per week, a flat $800 payment means my client received nothing for the 10 to 20 hours each week he worked beyond 40. Federal law requires overtime pay (at least one and a half times the regular rate) for every hour worked over 40 in a workweek. A flat weekly rate does not satisfy that obligation.

Allegations

Complete Ventures LLC and its owner Nathan Weaver misclassified my client as an independent contractor to avoid paying overtime. Under the federal economic reality test, my client was an employee. I am pursuing back overtime pay, liquidated damages, and attorneys' fees on his behalf.
